MOTION TO SUPPRESS EVIDENCE
TO THE HONORABLE JUDGE OF SAID COURT:
NOW COMES the Defendant, (Defendant’s Name) and moves to suppress all evidence obtained in this case as a result of an illegal stop and arrest by agents of the State of Texas and, in support thereof, would show the following:
I.
Defendant was stopped by law enforcement officers without any probable cause. He was arrested and taken into custody without any probable cause. All evidence obtained as a result of this illegal arrest should be suppressed, including any observation made by the officers.
II.
This Motion is based upon Defendant’s right to be free from unreasonable search and seizures under the U.S. Const., Amends. IV and XIV, and Tex. Const., Art. 1, Sect. 9.
WHEREFORE, PREMISES CONSIDERED, Defendant prays that this Motion be granted.
