What are the Penalties for Multiple DWIs in Texas?
A second DWI, like a first DWI, is considered a misdemeanor absent aggravating circumstances. Penalties for a second DWI conviction include:
- Fines of up to $4,000
- Jail for one month to a year
- Driver’s license suspension for up to 2 years
- Annual fee of $1,000, $1,500, or $2,000 for three years in order to retain your license
After two or more DWI convictions in five years, state law requires installation of an ignition interlock device. This is a switch that will prevent you from operating your vehicle if you have been drinking.
A third or subsequent DWI is considered a felony. Penalties may include:
- $10,000 in fines
- Jail for 2 to 10 years
